Discovery now underway in suit flied over car crashing into house

Discovery is now underway in litigation brought by Port Arthur resident Willie LaDay III, who sued Maribel and Said Nechar for injuries received when the vehicle in which he was a passenger crashed into a house.

As previously reported, the petition was filed July 11 in Jefferson County District Court.

Court records show that Said Nechar filed his first certificate of discovery on Aug. 7, serving LaDay with his request for disclosure, production and interrogatories.

A second certificate was filed on Sept. 5 by Said Nechar that served notice of his response to request for disclosure.

The lawsuit alleges that on July 9, 2010, LaDay was a passenger in a vehicle driven by Said and owned by Maribel. Said was traveling on Gulfway in Port Arthur when he swerved and left the roadway, causing the vehicle to crash into a house.

The suit accuses Said of negligently failing to control his speed and keep a proper lookout.

LaDay is suing for actual damages, plus all court costs.

Houston attorney Ryan Fowler of the Sloan, Bagley, Hatcher & Perry Law Firm represents him.

Humble attorney Kimberly Spurlock represents Said.

Judge Milton Shuffield, 136th District Court, is assigned to the case.
