SHERMAN - A Plano forklift operator has filed a lawsuit against his former employer claiming he was unlawfully terminated for taking intermittent leave in order to care for his disabled wife.
Aralandres Green filed suit against Packaging Corp. of America on Oct. 3 in the Eastern District of Texas, Sherman District.
Green was employed with the defendant from June 2007 to September 2012 as a forklift operator in Plano. During his employment, Green took approved intermittent leave to care for his disabled wife, according to the suit. He states that he was charged with excessive absenteeism points and improperly disciplined and terminated for taking FMLA leave.
Packaging Corp. is accused of discriminating and retaliating against Green by terminating his employment in violation of the Family Medical Leave Act.
The plaintiff is seeking damages for lost earnings and benefits, physical injury, mental pain and anguish, future impairment of ability to enjoy life, damages for loss of reputation and job opportunities, punitive damages, liquidated damages, court costs, attorneys’ fees and interest.
Green is represented by Allen attorney Dan A. Atkerson. A jury trial is requested.
U.S. District Judge Ron Clark is assigned to the case.
