Regent 1 Apartments hit with slip & fall suit

Last September, Port Arthur local Artie Polk slipped on some algae that had accumulated on a walkway at Regent 1 Apartments.

On Oct. 15 Polk filed suit against the complex in Jefferson County District Court, alleging the defendant failed to warn him of the hazard.

According to the lawsuit, on Sept. 14, 2011, Polk was injured when he stepped in an area where algae had accumulated due to standing water in a walkway.

“Plaintiff could not appreciate the danger as the algae was concealed,” the suit states. “Plaintiff was injured while walking in a designated walkway that should have been safe.”

Polk broke his ankle and suffered a facial injury because of the fall.

The suit accuses the defendant of negligently failing to maintain and inspect its premises and warn of the dangers condition.

The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain and impairment.

He is represented by attorney Jane Leger of the Beaumont law firm Provost Umphrey.

Judge Donald Floyd, 172nd District Court, is assigned to the case.
