Wrecked car3

A Silsbee man has filed suit against the recently deceased driver who he claims failed to control her vehicle and struck his.

Curtis Nortin claims defendant Emily Diane Ru was driving southeast on West Cardinal Drive at a high rate of speed when she lost control of her vehicle, crossed the median and struck Norton’s vehicle.

Because of the collision, Nortin suffered injuries to his neck, back and shoulder; incurred medical costs; and experienced physical pain, suffering and impairment, according to the complaint filed Oct. 22 in Jefferson County District Court. He also lost earnings and suffered mental anguish, the suit states.

Ru, who died in the collision, negligently failed to keep a proper lookout and drove too fast, the complaint says.

In his complaint, Nortin is seeking damages in excess of the minimum jurisdictional limits of Jefferson County District Court, plus exemplary damages, pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.

Travis McCall of Beaumont will be representing him.

The case has been assigned to Judge Donald Floyd, 172nd District Court.

Case No.  E193-380
