A Hardin County woman has filed a lawsuit claiming she suffered severe injuries when she slipped in liquid in fell while shopping at a Lumberton Wal-Mart. 

Shelly Rayner filed suit against Wal-Mart Stores Inc. on Sept. 28 in Hardin County District Court. The defendant removed the case to the Eastern District of Texas, Beaumont Division on Nov. 2.

The incident occurred on July 10 as Rayner was shopping, at the Wal-Mart store located in Lumberton when she slipped and fell in an accumulation of liquid on the floor.

The fall caused Rayner to suffer severe injuries to her back, arm and wrist.

The defendant is accused of negligence for:

failing to warn Rayner of a hazardous condition,

failing to inspect and properly clean the floor,

failing to post a warning, utilize cones or other warning devices,

failing to close off the dangerous area until the hazardous condition was eliminated,

failing to perform reasonable inspections of the premises,

failing to institute or follow adequate safety procedures to protect patrons, and for

failing to properly instruct or train the employees regarding inspection or cleaning of the premises.

The plaintiff is seeking damages for physical pain and suffering, mental anguish, medical expenses, lost wages, lost earning capacity, physical impairment, disfigurement, interest and court costs.

Rayner is represented by Sandee L. Hart of Hart Law of Orange. A jury trial is requested.

U.S. District Judge Ron Clark is assigned to the case.
