GALVESTON - Baytown resident Macy Garcia claims she was involved in a single-vehicle accident which occurred after a motorist allegedly inhaled a harmful substance, recent court documents say.
A lawsuit filed Nov. 8 in Galveston County District Court states Garcia was riding with League City local Austin Tyler Gaona on April 25, 2011, when he committed the act in question and crashed the Ford Expedition he was driving.
The suit says the subject wreck occurred after Garcia and Gaona were traveling south in the 600 block of Louisiana Avenue in League City.
According to the original petition, Gaona "suddenly stopped the vehicle in the middle of the road, inhaled a substance from a can, immediately accelerated the vehicle, then passed out behind the wheel with the vehicle traveling at a high rate of speed."
It further shows the Expedition veered off the roadway and hit a culvert, a telephone pole and a wooden fence and inflicted injuries upon the complainant.
Gaona is faulted for not properly observing traffic rules and regulations.
League City resident Erin Mica Brantley is also being sued because the Expedition presumably belonged to her.
A jury trial is requested.
Attorney David B. Jaroszewski of Houston is representing Garcia, and Galveston County 56th District Court Judge Lonnie Cox is presiding over the case.
