GALVESTON - Friendswood resident Felix Antonio Trevino is suing Santa Fe local Oscar Ochoa Gracia over an auto collision in Texas City two years ago, recent court documents say.
A lawsuit filed Dec. 5 in Galveston County Court at Law No. 3 claims Gracia caused the accident in question with Trevino the morning of Dec. 5, 2010.
The original petition shows Trevino was driving eastbound in the 3500 block of Palmer Highway while Gracia drove westbound in the 3400 block of the same roadway when both motorists came upon the open three-way intersection at the feeder road near Highway 146.
Trevino says he was on the far inside lane and tried to make a left turn on the protected left turn traffic signal onto the frontage road just as the defendant "barreled" through the intersection, ran the red light and crashed into him.
"The plaintiff's vehicle was totaled and [he] was violently thrown around the inside of his vehicle as a result of the impact," the suit says.
Trevino reportedly suffered injuries to his neck, back and legs.
He blames Gracia for:
- Failing to maintain a proper lookout;
- Failing to obey traffic signals; and
- Failing to yield to oncoming traffic.
Consequently, the plaintiff seeks unspecified monetary damages.
Attorney Paula Cundiff of League City is representing Trevino, and Galveston County Court at Law No. 3 Judge Christopher Dupuy is presiding over the case.
