Plaintiff settles Mardi Gras injury suit

A plaintiff who suffered an injury while at Mardi Gras has settled his suit. 

Frederick Jones filed suit against Mardi Gras Southeast Texas and AAA Rentals on Aug. 29, 2011, in Jefferson County District Court, alleging he was injured when a Mardi Gras tent fell on him during the March festival.

Court records show that an agreed final judgment was entered on Sept. 4, stating that Jones has settled with Mardi Gras Southeast Texas and no longer wishes to pursue his claim against AAA Rentals.

The judgment further states AAA Rentals its cross-claim against Mardi Gras Southeast Texas.

On April 5, AAA Rentals had filed an amended answer and cross-claim against Mardi Gras Southeast Texas, court records show.

The cross-claim alleged Mardi Gras Southeast Texas breached its contract with AAA Rentals by failing to secure it as an additional insured on its insurance policy.

The lawsuit claimed that on March 5, 2011, Jones was attending the Mardi Gras in Port Arthur when a tent leased by the defendants fell on him.

Jones alleged the defendants were responsible for the condition of the tent and should have made sure it was safe.

He was suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Judge Bob Wortham, 58th District Court, is assigned to the case.
