MARSHALL - Two Kilgore women have filed a lawsuit against a Shreveport, La., man claiming he failed to yield the right of way and caused a severe rear-end collision that caused the women severe injuries.
Tabitha Chamberlain and April Saxton filed suit against Scott Andrew Bowen on Jan. 4 in the Eastern District of Texas, Marshal Division.
The crash occurred on May 3, 2012, while Chamberlain was a passenger in a 1999 Lexus vehicle being driven by Saxton. They were traveling northbound on State Highway 135 in Kilgore and were slowing down to make a right hand turn into a private driveway when defendant Bowen collided into the rear of their vehicle, according to the suit.
The defendant is accused of negligence for failing to use ordinary care by various acts and omissions, failing to yield the right of way, failing to keep a proper lookout, failing to maintain proper driver attention, failing to make a timely application of the brakes, failing to turn the vehicle in order to avoid the collision and for failing to generally keep his vehicle under control.
Chamberlain and Saxton are asking for an award of damages for physical pain and mental anguish, emotional pain, torment and suffering, medical expenses, physical impairment, loss of earnings, loss of earning capacity, interest and court costs.
The plaintiffs are represented by Tyler attorney Keith Miller. A jury trial is requested.
U.S. District Judge Rodney Gilstrap is assigned to the case.
