Capital One sues over $15K debt

Capital One National Association has filed suit against Beaumont resident Martin Exiga, alleging he owes more than $15,000 on a past due small business credit account. 

The suit was filed Dec. 31 in Jefferson County District Court.

According to the lawsuit, Capital One advancing dollar amounts to the defendant on a credit account that he became obligated to pay.

In its suit, Capital One alleges that the defendant ceased making payments on the account, thereby creating a default.

Court records show that On Aug. 15 Capital One claims it sent a letter demanding payment but the defendant still refuses to repay the debt.

As of Dec. 5 the amount due and owing on the account is $15,877.93, the suit states.

“Defendant has presented its claim to defendant for payment, by defendant has failed and refused to pay the amount owed,” the suit states.

Capital One is suing for actual damages, interest court costs and attorney’s fees.

Carrollton attorney Michael Scott represents the lender.

Judge Gary Sanderson, 6oth District Court, is assigned to the case.
