GALVESTON - A Nebraska woman with cancer asserts she was injured in Galveston upon her return from a cruise last year and has filed a lawsuit.
Recent court documents filed Jan. 15 in the Galveston Division of the Southern District of Texas claim McRoberts Protective Agency made Jillann Olvera, who is handicapped, ride the escalator instead of the elevator at the arrivals area of the Galveston Cruise Terminal.
Olvera just disembarked from the M/V Mariner Of The Seas on Apr. 15, 2012, at the time of the events in question.
She says she tried to get on the elevator, but the defendant's employees refused her permission, stating they directed her to use the escalator.
The plaintiff complied with the instructions, and the respondent placed her, her luggage and another passenger's bags on the escalator.
According to the suit, the other passenger's luggage tumbled down the escalator, struck the complainant and knocked her down.
The purported incident caused Olvera to injure her knee, ankle and other parts of her body.
A "G-tube" that was in place to treat the plaintiff's illness was also dislodged during the fall, causing her more injuries, the original petition says.
Consequently, Olvera seeks a minimum of $1 million in damages and a jury trial.
