Man sues for damages sustained in rear-end collision

A Beaumont man claims he suffered severe injuries to his back, upper extremities and shoulders after a driver rear-ended him at an intersection. 

Peter Graves Byrd Jr. filed a lawsuit Jan. 28 in Jefferson County District Court against Hiep Bao Le.

In his complaint, Byrd claims he drove south on Fourth Street on June 11 at about 2 p.m. when he stopped his vehicle at its intersection with Cartwright Street in Beaumont and waited for the traffic light to change. Suddenly, Le rear-ended Byrd’s vehicle, according to the complaint.

“The impact of the collision was so significant that plaintiff’s vehicle was pushed into the vehicle in front of his 2008 Nissan Versa,” the suit states.

Because of the collision, Byrd incurred medical costs, experienced physical pain and suffering and endured physical impairment and mental anguish, the complaint says.

In his complaint, Byrd blames Le for casing the collision, saying he negligently failed to keep a proper lookout, failed to turn to the left or right to avoid a collision, failed to keep a clear distance between his vehicle and Byrd’s and drove too fast, among other negligent acts.

Byrd seeks a judgment for damages within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.

Kent W. Johns of Beaumont will be representing him.

Judge Bob Wortham, 58th District Court, has been assigned to the case.
