Suit over porch collapse dismissed

An order of dismissal was recently entered in a suit brought by plaintiff Chiquita Armstead, who claims she sustained injuries when her mother’s porch partially collapsed.

As previously reported, Armstead filed suit June 23, 2010, in Jefferson County District Court against Arthur Herbert, doing business as Yellow Rose Property Management Co.

Court records show that on Jan. 3 Judge Donald Floyd, 172nd District Court, signed an order of dismissal, stating that in October the parties announced to the court that the case had been settled but no judgment was filed within 10 days of the announcement.

The case was subsequently moved to the court’s try and dismiss docket and Judge Floyd dismissed the case for want of prosecution following a Jan. 3 hearing.

In her suit, Armstead claimed she was visiting a home her mother rented from Herbert at 1380 Pipkin St. in Beaumont when the incident occurred.

“Plaintiff stumbled when the porch partially collapsed causing her to fall backwards resulting in the injuries and damages made the basis of this suit,” the complaint says.

Armstead was seeking an unspecified judgment, plus pre-judgment interest, costs and other relief the court deems just.
