Beaumont business sued for not paying minimum, overtime wages

A Beaumont business is being sued for violating federal labor laws by not paying its employees appropriate minimum wages or overtime wages.

Michael Marsiglia, individually and on behalf of all similarly situated persons, filed suit against G S Global Supply L.P. and Beaumont RLC Inc. on Feb. 7 in the Eastern District of Texas, Beaumont Division. 

The plaintiff worked for the defendants by performing manual labor, performing maintenance and delivering products to customers. He was paid on a salary basis and was not paid an overtime premium for hours worked over 40 in a workweek, instead he was paid a set salary for all hours worked, according to the suit.

The defendant is accused of violating the Fair Labor Standards Act by not comply with the minimum wage or overtime provisions, the suit alleges.

The lawsuit will include other employees as the defendant is accused of is also accused of making a regular practice of paying non-exempt employees on a salary basis without paying the required overtime premium for hours worked over 40 in a workweek.

The plaintiff is seeking an award of damages for unpaid overtime wages, liquidated damages, interest, court costs and attorney’s fees.

Marsiglia is represented by Houston attorney Josef F. Buenker. A jury trial is requested.

U.S. District Judge Ron Clark is assigned to the case.
