Woman blames driver for causing collision

A Nederland woman has filed suit against the driver who she claims failed to yield the right-of-way while crossing an intersection.

Alisha White claims she was driving west on Avenue H in Nederland on Feb. 21, 2012, when defendant David C. Colten, who was crossing from Pine Lane to South 5 ½ Street in Nederland, failed to yield the right-of-way at an intersection and struck her vehicle.

Because of the collision, White suffered left foot, left leg, neck and lower back injuries; sustained great physical and mental pain, suffering and anguish; and incurred medical costs, according to the complaint. She also suffered emotional distress, the suit states.

White blames Colten for causing the collision, saying he negligently failed to keep a proper lookout, drove too fast, failed to drive in a safe manner and failed to timely apply his brakes.

In her complaint, White is seeking an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.

White will be represented by Lance P. Bradley and Craig J. Tahaney II of McPherson, Hughes, Bradley, Wimberley, Steele and Chatelain in Port Arthur.

The case has been assigned to Judge Donald Floyd, 172nd District Court.

Case No. E193-936
