Pedestrian blames truck driver for pushing parked car into him

A man has filed suit against the driver that struck the parked vehicle that ended up colliding with the man, tossing him several feet across a parking lot.

Cecil Vincent claims he was standing beside a parked vehicle in Modica Brothers’s parking lot on Sept. 4. Suddenly, he was thrown several feet and struck the pavement when a parked car was shoved into him, according to the complaint filed Feb. 27 in Jefferson County District Court.

Just before Vincent was injured, defendant Keith Avis Perkins had been driving a 2008 Ford F150 truck north in the 3200 block of Highway 347 when he struck a construction trailer, causing it to roll over. Despite the collision, Vincent continued to travel north into the 3300 block of Highway 347 and proceeded to strike a vehicle parked in front of Modica Brothers, the suit states.

In turn, that vehicle spun and hit another vehicle also parked in front of Modica Brothers. Vincent was standing beside that vehicle when it struck him, the complaint says.

Because of the incident, Vincent claims he incurred medical costs, experienced extreme physical pain and suffering and endured mental anguish and physical impairment. He also suffered disfigurement, according to the complaint.

Perkins negligently failed to keep a proper lookout, crossed the center line, failed to control his speed, failed to apply his brakes, drove inattentively, failed to drive on the right half of the road and drove while distracted, the suit states.

In his complaint, Vincent is seeking an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.
