A mortgage company has filed suit against the Beaumont woman who has allegedly defaulted on her loan and who refuses to surrender her manufactured home to the company.

21st Mortgage Corp. claims it lent defendant Sherri A. Ryan money to purchase a 2006 Southern Homes manufactured home on Dec. 5, 2005. Since then, however, Sherri Ryan defaulted on her loan, according to the complaint filed March 1 in Jefferson County District Court.

“As of February 5, 2013, after all just and lawful offsets there was due and owing, the amount of $24,111.16 in principal and interest, with interest continuing to accrue from that date until the date of judgment at the rate of 11.75% per annum,” the complaint says.

Defendant Ray Ryan currently lives in the home. Although he is not mentioned in Sherri Ryan’s contract, he is named as a defendant in the lawsuit because he refuses to vacate the property, the suit states.

In addition to the money it claims it is owed, 21st Mortgage Corporation is seeking pre- and post-judgment interest, attorney’s fees and other relief the court deems just. It also seeks possession of the manufactured home or proceeds from the sale of the home.

Richard A. McKinney and Maris E. Matocha of Higier, Allen and Lautin in Addison will be representing it.

The case has been assigned to Judge Bob Wortham, 58th District Court.
