A Port Neches woman claims she suffered from a torn rotator cuff following a rear-end collision.
Mindy Lightfoot claims she was driving east on FM 365 in Port Arthur. Near the 2900 block of FM 365, Lightfoot slowed down for a vehicle in front of her that was making a right-hand turn, according to the complaint filed March 11 in Jefferson County District Court. Suddenly, defendant Emilee Kay Biggers struck the back of Lightfoot’s vehicle, the suit states.
In addition to her torn rotator cuff, Lightfoot incurred medical costs; suffered extreme physical pain, suffering, mental anguish, physical disfigurement and physical impairment; and lost her earning capacity, the complaint says.
She blames Biggers for causing the collision, saying she negligently failed to stop before striking the vehicle in front of her, failed to take proper evasive action, failed to control the speed of her vehicle, failed to keep a proper and safe lookout and failed to properly yield the right-of-way.
In her complaint, Lightfoot is seeking an unspecified judgment, plus other relief the court deems just.
