Automobile collision suit dismissed

An automobile collision suit has been dismissed. 

As previously reported, Bridge city resident David McPherson filed suit against Daina Martinez on June 20, 2011, in Jefferson County District Court, alleging she rear-ended him.

Court records show that on Jan. 25 Judge Bob Wortham, 58th District Court, issued a order of dismissal with prejudice, stating that the parties have reached a settlement.

According to the lawsuit, on March 8, 2010, Martinez “rear-ended the vehicle in which McPherson was traveling, causing her (sic) significant injuries and damages.

The suit does not state where the collision occurred.

McPherson alleges Martinez negligently failed to keep a proper lookout, control her rate of speed and apply her brakes.

He was suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
