Texarkana woman sues over defective knee replacement device

TEXARKANA - A Texarkana woman has filed a lawsuit against the manufacturers of her knee replacement device claiming she suffered personal injuries that resulted in revision surgery. 

Deborah Nard filed suit against Zimmer Inc., Zimmer Holdings Inc. and Zimmer Orthopaedic Surgical Products Inc. on April 10 in the Eastern District of Texas, Texarkana Division.

Nard was implanted with a Zimmer NexGen knee device on her right knee on Dec. 14, 2010 at Christus St. Michael Health System in Texarkana by Dr. Jeffrey DeHaan. She was implanted with a Zimmer NexGen GSF CR-Flex. Approximately two years later, Nard underwent revision surgery.

The defendants are accused of strict liability, design defect, failure to warn, manufacturing defect, negligence, misrepresentation, express warranty, breach of express and implied warranty, redhibition, violation of consumer protection statutes and unjust enrichment.

The plaintiff is seeking an award of compensatory damages for injury, economic loss, pain and suffering, emotional distress, punitive damages, statutory damages, attorney’s fees, court costs and interest.

Nard is represented by Karen Beyea-Schroeder and George M. Fleming of Fleming Nolen & Jez LLP in Houston. A jury trial is requested.

U.S. District Judge Michael H. Schneider is assigned to the case.
