Driver blamed for causing collision after quickly backing out of driveway

An Oklahoma woman claims a driver caused her to collide with his vehicle when he suddenly backed out of a driveway.

Desiree Miller claims she was driving west in the 2300 block of E. Lucas Drive on Feb. 21, 2011, when defendant Joel Christopher Sterling backed out of a private driveway and caused Miller to strike him. In turn, Miller’s vehicle struck a telephone pole, according to the complaint filed April 1 in Jefferson County District Court. 

Because of the collision, Miller and her passengers -- Robert Scyrus Jr., Aubrey Scyrus and Darlene Bass – suffered serious and permanent injuries and experienced physical pain and mental anguish, the suit states. They also lost wages and their earning capacities, suffered physical impairment and incurred medical costs, the complaint says.

Miller blames Sterling for causing the collision, saying he negligently failed to control the speed of his vehicle, drove in a careless and reckless manner, failed to apply his brakes, failed to keep a proper lookout, failed to keep his vehicle under proper control, failed to reduce his speed to avoid a collision and failed to be attentive to his surroundings.

In her complaint, Miller is seeking actual damages, repair costs, court costs, pre- and post-judgment interest at the highest legal rate and other relief the court deems just.
