Progressive sued after insured’s collision with uninsured driver

Seeking to collect insurance benefits following an automobile collision with an uninsured driver, Delaine Sweat has filed suit against his provider, Progressive County Mutual Insurance. 

The suit was filed April 22 in Jefferson County District Court.

According to the lawsuit, on May 4, 2011, Sweat was injured as a result of a collision near 32nd Street in Groves when a vehicle operated by Charles Purgahn collided with his vehicle.

Purgahn, an uninsured driver at the time of the incident, negligently caused the collision, causing Sweat to suffer bodily injuries, medical expenses, pain, mental anguish and physical impairment, the suit alleges.

Sweat has complied with all the terms of his policy as a condition precedent to bring the suit.

He is suing for $100,000 in damages.

Houston attorney John Carwile represents him.

Judge Gary Sanderson, 6oth District Court, is assigned to the case.
