A Port Arthur woman claims she suffered neck, back and shoulder injuries after a driver rear-ended her vehicle.

Lee Pham filed a lawsuit April 23 in Jefferson County District Court against John Colvin.

In her complaint, Pham alleges she drove at the intersection of Lucas and Highway 69 where she waited to make a right-hand turn on July 13 when Colvin slammed into the back of her vehicle.

In addition to her injuries, Pham experienced physical pain and suffering, endured mental anguish and physical impairment and lost her earning capacity, according to the complaint. She also incurred medical costs, the suit states.

Colvin negligently failed to timely apply his brakes, failed to keep a proper lookout, failed to drive in a safe manner, failed to keep control of her vehicle, failed to keep a safe distance, failed to take evasive action and failed to control his speed, the complaint says.

In her complaint, Pham seeks an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.

Tom Oxford of Waldman Smallwood in Beaumont will be representing her.

Judge Bob Wortham, 58th District Court, has been assigned to the case.

Jefferson County District Court case number: A194-271.
