MARSHALL - A Tarrant County woman has filed a lawsuit against the manufacturers of vaginal mesh claiming that the device used in her surgery did not remedy her medical condition and has caused other complications.

Patricia A. Hammer filed suit against American Medical Systems Inc. on April 26 in the Eastern District of Texas, Marshall Division.

On Dec. 16, 2008, Hammer was treated at USMD Hospital in Arlington for prolapse bladder, cystocele and stress incontinence. An American Medical System’s Monarc Subfascial Hammock mesh was implanted.

She states that her medical condition was not remedied by this procedure and she began to experience gross hematuria. In addition, she claims that she continues to suffer from unbearable pain and that the mesh has been infected, dislodged, and possibly eroded.

The defendant is accused of strict liability, negligence and breach of warranty,

The plaintiff is seeking an award of damages for medical expenses, physical impairment, loss of enjoyment of life, pain and mental anguish, loss of earnings and earning capacity, court costs and interest.

Hammer is represented by Blake C. Erskine of Erskine & McMahon LLP in Longview and Dan Stroup of Dan Stroup PC in Longview. A jury trial is requested.
