Unpaid 90K bill for scaffolding results in litigation

GALVESTON - Claiming Liqui-Pro Industries Inc. and its agent, John A. Austin Jr., is outstanding on a $90,000 bill, Safway Services LLC pursues legal action.

A lawsuit filed May 6 in Galveston County District Court asserts the defendants owe Safway $89,400.92 for scaffolds they used on a project at the University of Texas Medical Branch in Galveston.

An agreement known as the John Sealy Tower Temporary Facade Repair was executed between the parties on April 20, 2012, which the plaintiff agreed to provide such labor and materials at the prices quoted in said agreement for which Liqui-Pro agreed to pay 30 days from the date of invoice, the suit says.

It adds Austin executed a certain personal guarantee in which he personally guaranteed the full payment of any debt that may be incurred by Liqui-Pro.

According to the complainant, Liqui-Pro "has failed and refused and continues to fail and refuse" to pay the full balance owed under the aforementioned agreement despite the former's full performance and continuous demand.

Attorney Arnold G. Polanco of Ross, Banks, May, Cron & Cavin, P.C. in Houston is representing the plaintiff, and Galveston County 122nd District Court Judge John Ellisor is presiding over the case.
