SHERMAN - A Grayson County woman has filed a lawsuit against her former employer claiming that she was fired as a result of age discrimination. 

Karla McLain filed suit against Fossil Partners LP and Fossil Inc. on May 10 in the Eastern District of Texas, Sherman Division.

McLain was hired by the defendant to work at their Richardson facility for more than 14 years. She was terminated on March 30, 2012, and at the time of her discharge she was 53 years of age.

According to the lawsuit, she was terminated for leaving without finishing her unit’s packing for the day, despite having worked a nine-hour workday.

McLain states that her unit was unable to complete its packaging of units because the products did not arrive in their unit in a timely manner.  McLain claims she was replaced by a younger, less experienced individual, who was 26 years of age, according to the suit.

The defendant is accused of violating the Age Discrimination in Employment Act, unlawful employment practices, and violations of the Americans with Disabilities Act.

The plaintiff is seeking an award of damages for mental anguish, liquidated damages, punitive damages, attorney’s fees, court costs and interest.

McLain is represented by Sherman attorney Ronald R. Huff. A jury trial is requested.
