Driver blamed for causing rear-end collision at traffic control device

A man claims he incurred medical costs after a driver rear-ended his vehicle.

Keithwick Spiller filed a lawsuit May 2 in Jefferson County District Court against Witze Drumgo Simmons. 

Spiller claims he drove in the right turning lane in the 1900 block of 11th Street in Beaumont on May 4, 2011, when he stopped at a traffic control device. At the same time, Simmons drove her 2010 Honda CRV in the same lane when she failed to obey the traffic control device and struck the back of Spiller’s vehicle, according to the complaint.

In addition to his medical costs, Spiller claims he suffered physical pain and mental anguish and endured physical impairment and disfigurement.

Spiller blames Simmons for causing the collision, saying she negligently failed to keep a proper lookout, failed to control her speed, failed to obey traffic laws, failed to timely apply her brakes and failed to abide by traffic control devices.

In his complaint, Spiller seeks actual damages within the jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest, costs, exemplary damages and other relief the court deems just.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
