Recent patent infringement cases filed in the Eastern District of Texas

Marshall Division 

May 6

• Black Hills Media v. Samsung Electronics Co. Ltd. et al Case No. 2:13-cv-00379

Black Hills is a privately held Delaware limited liability company with a principal place of business in Wilmington, Del., and business offices in Durham, N.C.

The defendants are accused of infringing on:

• U.S. Patent No. 8,028,323 issued Sept. 27, 2011, for Method and System for Employing a First Device to Direct a Networked Audio Device to Obtain a Media Item;

• U.S. Patent No. 8,214,873 issued July 3, 2012, for Method, System and Computer-Readable Medium for Employing a First Device to Direct a Networked Audio Device to Render a Playlist;

• U. S. Patent No. 8,230,099 issued July 24, 2012, for  System and Method for Sharing Playlists;

• U.S. Patent No. 8,045,952 issued Oct. 25, 2011, for Method and Device for Obtaining Playlist Content Over a Network;

• U.S. Patent No. 8,050,652 issued Nov. 1, 2011, for Method and Device for an Internet Radio Capable of Obtaining Playlist Content from a Content Server;

• U.S. Patent No. 7,835,689 issued Nov. 16, 2010, for Distribution of Music between Members of a Cluster of Mobile Audio Devices and a Wide Area Network;

• U.S. Patent No. 7,917,082 issued March 29, 2011, for Method and Apparatus for Creating and Managing Clusters of Mobile Audio Devices;

• U.S. Patent No. 6,618,593 issued Sept. 9, 2003, for Location Dependent User Matching System; and

• U.S. Patent No. 6,108,686 issued Aug. 22, 2000, for Agent-Based On-line Information Retrieval and Viewing System.

Black Hills is asking the court to enjoin the defendants from further infringement and for an award of damages, treble damages, court costs and attorneys’ fees.

The plaintiff is represented by Claire Abernathy Henry, T. John Ward Jr. and J. Wesley Hill of Ward & Smith Law Firm in Longview; H. A jury trial is requested.

U.S. District Judge Rodney Gilstrap is assigned to the case.

 

• National Cheng Kung University v. GEO Semiconductor Inc. Case No. 2:13-cv-00380

National Cheng Kung University is a higher education institution with a principal address of No. 1, University Road, Tainan, Taiwan, R.O.C.

The defendant is accused of infringing on U.S. Patent No. 7,561,078 issued July 14, 2009, for System and Method for Encoding a Data Set.

National Cheng Kung University is asking the court to issue an injunction and for an award of damages, costs, expenses, interest and enhanced damages.

The plaintiff is represented by Winston O. Huff and Deborah Jagai of W. O. Huff & Associates, PLLC in Dallas.

A jury trial is requested.

U.S. District Judge Rodney Gilstrap is assigned to the case.

• Sampo IP v. Ambit Energy Holdings et al Case No. 2:13-cv-00386

Sampo is a Virginia corporation with a principal place of business located in Alexandria, Va.

The defendants are Ambit Energy Holdings, BMC Software Inc., Homeway Inc., Hoover’s Inc. and Ristken Software Services.

The defendant is accused of infringing on U.S. Patent Nos. 6,161,149; U.S. Patent No. 6,772,229; and U.S. Patent No. 8,015,495; all entitled Centrifugal Communication and Collaboration Method.

The plaintiff is seeking an award of actual damages and interest.

Lodsys is a Texas limited liability company with its principal place of business in Marshall.

The patents at issue include U.S. Patent 7,620,565 issued Nov. 17, 2009, for Customer-Based Product Design Module and U.S. Patent No. 7,222,078 issued May 22, 2007, for Methods and Systems for Gathering Information from Units of a Commodity Across a Network.

Lodsys is asking the court to issue an injunction preventing the defendants from further acts of infringement and for an award of damages, treble damages, attorney’s fees and court costs.

The plaintiff is represented by William E. Davis III of the Davis Law Firm in Longview and Michael A. Goldfarb and Christopher M. Huck of Kelley, Donion, Gill, Huck & Goldfarb in Seattle, Wash.

A jury trial is requested.

Institute For Information Industry is an information industry research institution with a principal address of 11F, No. 106, Section 2, Heping East Road, Taipei, Taiwan, R.O.C.

The defendant is accused of infringing on U.S. Patent No. 6,845,354 issued Jan. 18, 2005, for Information Retrieval System With A Neuro-Fuzzy Structure.

The plaintiff is asking the court to issue an injunction to prevent further infringement and for an award of damages for damages, costs, expenses, interest, enhanced damages and attorney’s fees.
