Convenience store sued for not paying cashier overtime wages

TYLER - A cashier is suing an East Texas convenience store for violating federal law by only paying her straight time and not paying her overtime wages. 

Suzan Jeter filed suit against Fazio Inc., doing business as Kwik Stop, and Mohammed Anwar individually on May 15 in the Eastern District of Texas, Tyler Division.

Jeter was employed by the defendant as an hourly paid cashier and cook. She states she routinely worked more than 40 hours per week but was paid straight time for overtime, rather than time and a half her regular rate of pay for overtime.

The defendants are accused of violating the Fair Labor Standards Act by failing to pay Jeter in accordance with the Fair Labor Standards Act, specifically not paying Jeter time- and one-half the regular rate of pay for the hours that she worked over 40 hours per week.

The plaintiff is seeking an award of damages for unpaid back wages, liquidated damages, court costs, attorney’s fees and interest.

Jeter is represented by Robert Lee, J. Derek Braziel, Carmen Artaza and Meredith Mathews of Lee & Braziel L.L.P. in Dallas.

A jury trial is requested.

U.S. District Judge Michael H. Schneider is assigned to the case.
