Alleging the placement of a vaginal mesh has caused “unimaginable” pain, Orange local Dana Bergeron has filed suit against the makers of the product and the doctor who performed the surgery.
Bergeron filed suit against Dr. Donald Long and Boston Scientific Corp. on May 14 in Jefferson County District Court.
According to the lawsuit, Bergeron underwent placement of a Boston Scientific pelvic mesh product to repair stress urinary incontinence (bladder leakage). Dr. Long performed all of the procedures at Chirstus Hospital St. Mary in Port Arthur.
“Since her surgery, Dana Bergeron has suffered pain and injuries which are unimaginable,” the suit states.
“Due to the profound pelvic pain and discomfort she has experienced since her implantation surgery, it is highly possible that she will need additional surgery to remove the mesh from her vagina, which could cause additional severe and permanent pain and discomfort.”
The suit accuses Long of negligently failing to inform Bergeron of the risk and implanting the mesh despite having actual knowledge of its high failure and complication rates.
On top of designing and marketing a defecting product, Boston Scientific is accused of negligently failing to test its product and instruct physicians in the proper training for safe use.
The plaintiff is seeking an award of exemplary damages and is also suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
She is represented in part by Port Arthur attorney Brandon Monk.
Judge Bob Wortham, 58th District Court, is assigned to the case.
