Area resident Thurman Capps is suing his dentist, John LeBlanc DDS, for not catching his oral cancer.
The suit was filed May 15 in Jefferson County District Court.
According to the lawsuit, Capps was a patient of LeBlanc and sought treatment for a persistent oral ulcer. During the treatment, Capps was not diagnosed with oral cancer but was told to buy special mouthwash.
On Jan. 27, 2012, Capps was diagnosed with Stage IV oral cancer and referred to M.D. Anderson Cancer Center in Houston for treatment.
In his suit, Capps clams he has suffered significant pain and permanent injuries due to the significant delay in diagnosing his oral cancer.
Capps had to have his tongue and teeth removed.
The suit accuses LeBlanc of violating the duty of care owed to Capps and being negligent in his treatment.
On top of exemplary damages, the plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages.
