Texas man sues driver for allegedly failing to keep lookout

A Texas man claims he sustained pain when a driver suddenly pulled in front of his vehicle and collided with his truck and the trailer he was hauling.

Kevin Jones filed a lawsuit May 15 in Jefferson County District Court against Laquinta Hadnot.

In his complaint, Jones alleges he drove his 2008 Ford F150 pickup while towing a trailer on Sept. 12 when Hadnot pulled out in front of him from a convenience store parking lot.

Because of the collision, Jones sustained property damages to his pickup truck and trailer, suffered damages to the personal property that was being transported and lost the use of his pick-up truck, according to the complaint. He also lost the use of his trailer, lost business profits, experienced physical pain and mental anguish, endured physical impairment and physical disfigurement, incurred medical costs and lost his earnings and earning capacity, the suit states.

Jones blames Hadnot for causing the collision, saying she negligently failed to yield the right-of-way, failed to keep a proper lookout and violated Texas laws, the complaint says.

In his complaint, Jones seeks an unspecified judgment, plus pre- and post-judgment interest at the legal rate, costs and other relief the court deems just.

Paul F. Ferguson Jr. of Provost Umphrey Law Firm in Beaumont will be representing him.

Judge Bob Wortham, 58th District Court, has been assigned to the case.

Case No. A194-341
