Man seeks damages after collision

The injured man who was hurt in a collision more than two years ago says a driver rear-ended his vehicle and caused the collision. 

Michael Schmidt filed a lawsuit May 15 in Jefferson County District Court against Lance Killian and Allstate Property and Casualty Insurance Co..

In his complaint, Schmidt claims he drove in the 700 block of Magnolia in Port Arthur on Sept. 4, 2011, and was attempting to turn into a private driveway when Killian struck the back of his vehicle.

Because of the collision, Schmidt suffered injuries to his neck and back; endured a deteriorated state of physical and mental health; and experienced great physical and mental pain, suffering and anguish, according to the complaint. He also incurred medical costs and lost his earnings, the suit states.

Schmidt blames Killian for causing the collision, saying he negligently failed to keep a proper lookout, drove too fast, failed to drive in a safe manner, failed to apply his brakes in a timely manner to avoid a collision and failed to keep a safe distance between his vehicle and Schmidt’s.

In his complaint, Schmidt seeks an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
