A Port Arthur woman has filed suit against the allegedly unlicensed driver who she claims struck her as she was walking near an intersection.

Marta Farias claims she was walking north near the corner of Ninth Avenue and Lake Arthur Drive in Port Arthur on May 23, 2011, when defendant Tina Renee Malone, who was driving a maroon 2005 Chrysler Sebring, struck her. 

Because of the collision, Farias experienced physical pain and mental anguish, endured disfigurement and physical impairment and lost her enjoyment of life, according to the complaint filed May 23 in Jefferson County District Court. She also lost wages and her earning capacity and incurred medical costs, the suit states.

Malone negligently drove without a license, drove too fast, drove in a careless and reckless manner, failed to apply her brakes before the collision, failed to keep a proper lookout, failed to keep her vehicle under proper control, failed to pay attention, failed to control her speed, failed to yield the right-of-way, failed to reduce her speed to avoid a collision and failed to keep a safe distance between her vehicle and Farias’s, the complaint says.

In her complaint, Farias is seeking unspecified punitive damages, plus pre- and post-judgment interest, costs and other relief the court deems just.

Johnnie Carter III of the Law Offices of Johnnie Carter in Houston will be representing her.

Judge Bob Wortham, 58th District Court, has been assigned to the case.
