GALVESTON - GTE Southwest Inc.'s lawsuit targeting a north Galveston County man over alleged property damage was recently amended, court records show.
The suit, filed April 10 before the Galveston County 56th District Court, blames Roderick T. Foster for ruining one of its cables located in Kemah two years ago.
According to the original petition, Foster was operating a dump truck near the plaintiff’s property on May 16, 2011, at the time of the alleged incident.
Foster was backfilling a property with dirt when the vehicle purportedly struck an aerial cable belonging to the complainant, it says.
The complainant, doing business as Verizon Southwest, states the accident caused damages of $3,596.30.
Foster is accused of failing to exercise ordinary care to prevent damage to the plaintiff’s property and failing to keep a proper lookout to see the aerial cable.
The company edited the suit on May 13 to say Foster "knew the aerial cable was low and should have contacted [it] to have the cable raised."
It also names San Leon local Roderick Thomas Foster Sr. as a defendant in the case.
Each respondent has filed an original answer.
