Customer sues Lowe’s after tripping over paving stones

MARSHALL - After tripping over paving stones and falling, Claudia Harvey has filed a lawsuit against Lowe’s Home Centers Inc. on June 6 in the Eastern District of Texas, Marshall Division.

The accident occurred on Oct. 8, 2011 as Harvey was at Lowe’s and she fell over patio or paver stones, striking the ground. Harvey claims she suffered serious bodily injuries as a result of the fall.

The defendant is accused of negligence for failing to properly inspect and maintain the premises to discover the dangerous condition, failing to maintain the premises in a reasonably safe condition, failing to give warning to Harvey of the unsafe condition of the premises, and for failing to give adequate and understandable warnings to Harvey of the unsafe condition of the premises.

The plaintiff is seeking an award of damages for medical care and expenses, physical pain and suffering, mental anguish, physical impairment, physical disfigurement, loss of earning capacity, interest and court costs.

Harvey is represented by Brett Goudarzi and Marty Young of Goudarzi & Young LLP in Gilmer. A jury trial is requested.
