Worker sues for $120K in unpaid overtime wages

TYLER - Claiming she is owned at least $120,000 in overtime wages, Tammy D. Lewis, individually and on behalf of all others similarly situated, has filed a lawsuit against Maximus Inc. on June 14 in the Eastern District of Texas, Tyler Division. 

According to the lawsuit, Lewis began working for the defendant on June 5, 2006, and was eventually promoted to a workforce analyst or workforce management analyst. In this position she was classified as exempt from the overtime requirements of the Fair Labor Standards Act.

She claims she worked more than 40 hours during most, if not all, work weeks during the last three years, but was only paid straight salary regardless of the hours worked. Lewis estimates she worked over 6,000 hours of overtime during the last three years.

The lawsuit states that other workers classified as workforce analysts and workforce management analysts were not properly paid for overtime hours.

The plaintiff is seeking an award of damages for unpaid compensation, liquidated damages, attorney’s fees, court costs and interest.

Lewis is represented by Dallas attorney Donald E. Uloth. A jury trial is requested.

U.S. District Judge Michael H. Schneider is assigned to the case.
