Directv filed suit against Lufti Ghousheh and Kenan, doing business as Chicago Gourmet Pizza, on July 2 in the Eastern District of Texas, Sherman Division.
According to the lawsuit, the defendants, without a commercial account with DirecTV, displayed DirecTV satellite programming to the public and for commercial gain on Nov. 5, 2011.
Chicago Gourmet Pizza is accused of unlawfully converting the plaintiff’s property for their own commercial use and benefit.
“Such conversion was done intentionally and wrongfully by Defendants to deprive Directv of its proprietary interest, and for Defendants’ direct commercial benefit and advantage,” the lawsuit states.
The plaintiff is seeking an award of statutory damages in an amount not less than $10,000 and up to $100,000 for each willful violation, punitive damage, court costs, attorney’s fees and interest.
Directv is represented by Julie Cohen Lonstein of Lonstein Law Office P.C. in Ellenville, N.Y.
U.S. District Judge Richard A. Schell is assigned to the case.
