Truck dispatcher sues employer for not paying overtime wages

MARSHALL - A truck dispatcher has filed a collective action lawsuit against his employer claiming that he was not paid overtime wages.

Michael Juno, individually and on behalf of all others similarly situated, filed suit against Martin Resource Management Corp. on July 17 in the Eastern District of Texas, Marshall Division. 

Juno was employed at Martin Resource as a truck dispatcher job and claims he was not paid overtime wages at one and one-half times his regular hourly rate for all hours worked in excess of 40 hours in a work week. Juno claims that the defendant’s failure to pay overtime pay was intentional.

The lawsuit is filed on behalf of similarly situated employees, who were not paid for all overtime hours worked by Martin Resource.

The defendant is accused of violating the Fair Labor Standards Act.

The plaintiff is seeking an award of damages for unpaid overtime, liquidated damages, attorney’s fees, and court costs.

Juno is represented by William S. Hommel Jr. of Hommel Law Firm in Tyler. A jury trial is requested.

U.S. District Judge Rodney Gilstrap is assigned to the case.
