GALVESTON - Harris County residents An Quoc Ho and Huong Vo are suing Government Employees Insurance Co. for proper coverage in response to a two-vehicle accident last year in Galveston.
A lawsuit filed July 19 in Galveston County District Court states that the plaintiffs were reportedly hit by an unknown motorist on or near Broadway on May 26, 2012.
The driver, who is believed to lack insurance coverage, fled the scene of the wreck afterwards, the suit says.
"The driver responsible for this accident did not have liability coverage," the original petition says.
"The injuries sustained by the plaintiffs were not the result of intentional acts, but were accidental and caused by the negligence of the uninsured driver."
It adds the complainants did nothing to bring forth the incident in question.
GEICO subsequently received a claim on the collision from the plaintiffs, but "breached its contract with the plaintiffs by refusing to pay or underpay the claim."
According to the suit, the insurer was timely informed of the event, and that the complainants intended to claim uninsured benefits.
A jury trial is requested.
