Trial over alleged botched surgery ends with 'no negligence' verdict

A medical malpractice trial centered on a woman’s claim that her doctor somehow botched her surgery ended with a verdict of no negligence on the part of the physician.

As previously reported, Lisa Moseley (not Lisa Allen) filed suit against Dr. Darioush Kavouspour and Surgical Critical Care Associates on Feb. 1, 2011, in Jefferson County District Court. 

The case went to trial July 23 in Judge Milton Shuffield’s 136th District Court and ended two days later.

According to the court’s charge to the jury, no negligence on the part of Dr. Kavouspour caused the injury in question.

According to the original petition, on Oct. 6, 2009, Dr. Kavouspour operated on the plaintiff at Christus Hospital St. Elizabeth in Beaumont.

However, the suit does not state what operation he performed or her medical condition.

She asked jurors to award her damages for her alleged past and future mental anguish, pain and disfigurement.

Houston attorney Craig Lewis represents her.

The defendants are represented by Houston attorney Frank Luccia of Luccia & Evans.
