Women sue driver they blame for causing rear-end collision

Two women have filed suit against the driver who they claim rear-ended their vehicle.

Katiusca Medina and Giulia Rispetti claim Medina was driving south in the 6100 block of Eastex Freeway in Beaumont on Dec. 24, 2011, when defendant William Gieseke, who was driving behind her, struck the back of her vehicle. At the time, Rispetti was riding as a passenger in the vehicle, the complaint says.

Because of the collision, Medina suffered physical pain and mental anguish, endured physical impairment and lost wages and her earning capacity, according to the complaint filed July 16 in Jefferson County District Court. She also incurred medical costs, the suit states.

Medina and Rispetti blame Gieseke for causing the collision, saying he negligently failed to keep a proper lookout, failed to properly apply his brakes, failed to control his speed, failed to maintain proper control of his vehicle and failed to take proper evasive action.

In their complaint, the plaintiffs seek a judgment of more than $200,000 but no more than $1 million, plus pre- and post-judgment interest at the legal rate, costs and other relief the court deems just.

Ronald M. Estefan of The Estefan Firm in Houston will be representing them.

The case has been assigned to Judge Bob Wortham, 58th District Court.
