SHERMAN - A Cooke County man has filed a lawsuit claiming a debt collection company violated federal law by failing to disclose it was attempting to collect on a debt when it threatened a lawsuit.

Kendall Tepfer filed suit against Galaxy Capital Solutions Inc. on Aug. 12 in the Eastern District of Texas, Sherman Division. 

Tepfer claims that the defendant placed multiple collection calls and left multiple voicemail messages, which threatened a lawsuit.

The defendant is accused of violating the Fair Debt Collection Practices Act and the Texas Finance Code by failing to disclose it was attempting to collect a debt.

“Defendant intentionally intruded on the Plaintiff’s solitude, seclusion, or private affairs, and such intrusion would be highly offensive to a reasonable person,” the lawsuit states.

The plaintiff is seeking an award of actual damages, statutory damages, attorney’s fees and court costs.

Tepfer is represented by Rockwall attorney Jeff Wood. A jury trial is requested.

U.S. District Judge Ron Clark is assigned to the case.
