Texas City woman non-suits Houston motorist who hit her near workplace

GALVESTON - A Texas City woman who sued after she was was hit by a car while going back to work at a Galveston store two years ago has non-suited the defendants.

Nina Garcia entered a notice of non-suit July 22 into her personal injury lawsuit, effectively dismissing Houston resident Ross Dillon Ward and Bastrop County resident Michelle Crossley.

Garcia's suit, filed three months ago, alleged that on May 12, 2011, Ward struck the plaintiff suddenly and without warning as she was walking across a parking lot to re-enter the Big Lots where she works.

He was blamed for:


  • Failing to keep a proper lookout;

  • Failing to yield;

  • Failing to turn said vehicle away;

  • Failing to maintain a clear and reasonable distance between the complainant and himself;

  • Failing to obey the speed limit; and

  • Failing to apply the brakes.


Meanwhile, Crossley was sued because the vehicle Ward drove at the time of the auto-pedestrian accident belonged to her.

Neither defendant provided an original answer to Garcia's allegations.
