GALVESTON - A Hempstead woman claims she was in a two-vehicle accident in La Marque more than a year ago and has filed a lawsuit, recent court documents say.
Amanda Robinson's suit, filed Aug. 23 in Galveston County District Court, blames La Marque local David Campbell Jr. for the Nov. 28, 2011, wreck which allegedly caused spinal disc herniation in the plaintiff.
Prior to the subject event, Robinson was traveling northbound in the left lane on Delaney Road while Campbell drove southbound.
The original petition further states that Campbell attempted a left hand turn onto Casey Street, but failed to give the complainant the right-of-way, "resulting in the collision between the two vehicles."
In addition to disc bulging, the collision allegedly inflicted muscle spasms and headaches as well as shoulder and back pain on Robinson, the suit says.
It faults the respondent for:
- Failing to keep a proper lookout;
- Failing to stop, yield and grant immediate use of the intersection to the plaintiff's vehicle after it had entered the intersection; and
- Failing to enter into the intersection only when he could have safely entered without interference or collision with other traffic.
Consequently, Robinson seeks $69,399 in damages and a jury trial.
She is represented by attorney David J. LaRue of Loncar & Associates in Houston.
The suit has been assigned to Galveston County 10th District Court Judge Kerry L. Neves.
