Locomotive engineer sues after railcars collide with his train

A locomotive engineer has filed a lawsuit claiming he was injured when railcars collided with his locomotive. 

Corey Sessions filed suit against BNSF Railway Co. on Aug. 22 in Beaumont Division of the Eastern District of Texas.

Sessions claims he was injured on Sept. 3, 2012, while he was employed by the defendants as a locomotive engineer. While waiting on a locomotive in the Dayton Yard, Sessions states he was injured when railcars collided with his locomotive.

The defendant is accused of negligence for failing to provide a safe place to work, negligently causing cars to collide with the locomotive that Sessions was on, negligently performing switching operations, failing to enact and/or enforce procedures for switching, failing to train and instruct employees on the proper procedure for switching cars, failing to warn Sessions, failing to communicate with Sessions, failing to follow Session’s safety and operating rules, and for failing to conduct a proper inspection of the tracks prior to releasing rail cars into the track occupied by Sessions.

The plaintiff is seeking an award of damages for permanent impairment, physical pain, mental anguish, lost wages and benefits, loss of earning capacity, medical expenses, disfigurement, interest and court costs.

Sessions is represented by Clint E. McGuire of The Law Firm of Alton C. Todd in Friendswood. A jury trial is requested.

U.S. District Judge Marcia A. Crone is assigned to the case.
