Two Winnie residents allege they suffered pain after a driver collided with the vehicle in which they were riding.

Robert Mirabella and Sara Phelps Mirabella filed a lawsuit Aug. 23 in Jefferson County District Court against Shannon Lynn Washington and Slay Transportation Co.

In their complaint, the Mirabellas allege they were traveling east on State Highway 73 in Jefferson County on Sept. 1, 2011, when Washington, who was working for Slay Transportation, struck their vehicle.

In addition to their pain, the Mirabellas suffered mental anguish and physical impairment, incurred medical costs and lost wages, according to the complaint. They also lost their earning capacities and each other’s affection, solace, comfort, companionship, society, assistance and sexual relations, the suit states.

The Mirabellas blame Washington for causing the collision, saying he negligently failed to control his speed, drove too fast, failed to keep a proper lookout, failed to keep a safe distance between his vehicle and the Mirabellas and failed to swerve to avoid a collision, among other negligent acts.

In their complaint, the Mirabellas are seeking unspecified damages, plus pre- and post-judgment interest at the highest legal rate, costs and other relief the court deems just.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
