Mediation agreement closes lawsuit against Houston motorists

GALVESTON - Houston resident Salma A. Farooqui decided not to push further with her lawsuit over an October 2012 two-vehicle accident in League City, recent court records show.

Farooqui non-suited the defendant, Erasmo Lopez, on Aug. 21, effectively ending the barely six-month-old litigation.

An order is currently pending.

Lopez, also of Houston, was sued in March for the subject event on Oct. 5, 2012, which the plaintiff alleged gave her severe whiplash as well as debilitating injuries.

Farooqui was traveling southbound along a feeder section of Interstate 45 near Main Street prior to the wreck.

She said she was at a traffic light anticipating a right turn onto Main when Lopez collided into the rear of her vehicle.

According to the original petition, the respondent was using his cell phone while driving and was not in possession of a valid driver’s license.

It added the plaintiff was caught unaware by the accident’s impact, which caused her injuries to her neck, shoulders, arms, back and other parts of her body.

Meanwhile, Lopez formally refuted the allegations earlier this year.

Aside from Farooqui's notice of non-suit, both parties also reached a mediation agreement, according to a Aug. 12 letter written to Galveston County 405th District Court Judge Michelle Slaughter by attorney Will Cannon of Cannon Mediation Group, L.P. in Houston.

Farooqui originally sought $99,999 in damages.

Attorney Clara Medina Toman of Houston represented Lopez.
