Area resident Brandi Morrison Wigley, owner of the vessel Ragin Ravyn, is suing Jose Cuevas, owner of the vessel Mom and Dad, alleging no one was steering the ship when it struck Wigley’s.
The suit was filed Aug. 27 in Jefferson County District Court.
According to the lawsuit, on June 18, 2012, the plaintiff was out at sea out of Sabine Pass when the defendant’s vessel was heading straight for the plaintiff’s.
“There was no one in the wheel house of the Mom and Dad steering the boat,” the suit states, adding that the vessel just missed striking the plaintiff’s but caught the riggings, causing the Ragin Ravyn to nearly capsize.
The defendant’s vessel never stopped to leave their information or make sure everyone was safe from the encounter, the suit claims.
The suit alleges the defendant negligently failed to keep a proper lookout and failed to man the wheelhouse at all times.
The plaintiff is suing for cost of repairs and lost earnings from the Ragin Ravyn, plus attorney’s fees and court costs.
Judge Milton Shuffield, 136th District Court, is assigned to the case.
