Bicyclist non-suits League City motorist who sent him into oncoming traffic

GALVESTON - A local bicyclist recently moved to non-suit a League City man he claimed hit him along FM 518, according to recent court records.

Dylan Rain Chudleigh filed a notice of non-suit into his personal injury lawsuit against Mark Curnell Martin on Aug. 30, merely ending the legal battle roughly four months after it began.

An order to be signed by Galveston County Court-at-Law No. 3 Judge Kerri Foley is reportedly pending.

Chudleigh previously alleged that Martin struck him to the point the impact of the accident sent him into in the path of oncoming traffic.

The plaintiff explained that he was in the process of crossing Maple Leaf Drive near the 6800 block of FM 518 when the defendant pulled out ahead on 518 and hit him.

Chudleigh's suit stated he was catapulted into the air and ended up in the middle of the inside lane of the two eastbound lanes of a busy Main Street, the other name of 518.

“The rear wheel of the plaintiff’s bicycle was impacted by the front driver’s side fender of the defendant’s vehicle near the middle of the crossway of Maple Leaf Drive,” the suit said.

Martin formally refuted the allegations on May 6.
